D. Procedures for hearing alleged violations of all other community standards of conduct
4. Considerations for recipients of sexual/physical aggressive/ violent behavior
In consideration of the traumatic nature of incidents of sexual/physical aggressive/violent behavior, the College will permit recipients to request special accommodation during the hearing. The recipient of sexual/physical aggressive/violent behavior is afforded the right to pursue disciplinary action including the option to:
a. Be present throughout a disciplinary hearing conducted for the accused student in response to the charges. In consideration of the traumatic nature of incidents of sexual/ physical aggressive/violent behavior, the College will permit recipients to request special accommodation during the hearing, including a screen to separate them from the accused student and/or the presence of a support person either from the campus community or from a victim assistance agency.
b. Produce and question witnesses.
c. Present information/statements without direct contact with the accused as long as there is no infringement upon the accused student’s right to question the witness through the board (i.e., provide statements via speakerphone rather than being present in the room with the accused).
d. Submit possible questions to the Hearing Committee/officer in advance of the hearing.
e.. Submit an impact statement.
f. Have past unrelated behavior excluded from the hearing.
g. Have a separate waiting area.
h. Be kept informed about the process.
i. Be informed of the outcome of any disciplinary action.
